What is earnest money?
Earnest money is a good-faith deposit a buyer submits with an offer to show the seller they're serious about purchasing the property. It's one of the first financial commitments in a Georgia real estate transaction, and it helps strengthen your offer in a competitive market.
Here's how it works in Georgia:
- Held in a separate escrow or trust account until closing
- The purchase agreement names who holds it — often the closing attorney
- No state-set amount; it's negotiated, commonly about 1–3% of the price
- Applied toward your closing costs or down payment at closing
- Refundable if you terminate within your contract's contingencies
- May be forfeited if you default without a valid contractual reason
