What to do after a crash

The days after an accident matter more than most people realize. Here's what protects both your health and your claim.

Get medical care

See a doctor even if you feel okay — some injuries take days to show up, and a gap in treatment is the first thing an insurer will point to.

Report the crash

Make sure police responded and a report was filed. Ask for the report number before you leave the scene.

Document everything

Photos of the vehicles, the road, your injuries, and the other driver's insurance card. Get names and numbers of any witnesses.

Don't give a recorded statement

You're not required to speak with the other driver's insurance company. Politely decline and refer them to your attorney.

Keep your records

Save medical bills, repair estimates, pay stubs for missed work, and any letters from insurers. Everything is easier to prove with paper.

Deadlines and rules that affect your case

Georgia's rules can shorten or shrink a claim if you wait. Two of the most important to know:

Statute of limitations. Most Georgia personal injury claims must be filed within two years of the accident, or the right to sue is lost.
50%
Comparative fault. You can still recover if you were partly at fault — as long as you were less than 50% responsible — but your award is reduced by your share.

How much is my case worth?

It depends on your medical expenses, lost wages, the seriousness and permanence of your injuries, and how the crash affects your daily life. Anyone who quotes you a number before reviewing your records is guessing. We evaluate your damages carefully before we negotiate — and we won't recommend a settlement that leaves your future care unpaid.

The insurance company already made an offer. Should I take it?

Early offers are usually low, and accepting one closes your claim for good — even if your injuries turn out to be worse than you thought. Let us review the offer against your actual damages first. There's no cost to find out.

What if the other driver doesn't have insurance?

You may still recover through the uninsured/underinsured motorist coverage on your own policy. We review all available coverage — yours, the other driver's, and sometimes an employer's or a vehicle owner's — to find every source of recovery.

What if I was partly at fault?

Georgia allows recovery as long as you were less than 50% at fault; your award is reduced by your percentage of responsibility. Insurers often overstate your share to lower what they owe. We push back with the evidence.

How long will my case take?

Do I have to go to court?
